Maryland high school thrust into immigration debate
“ICE examined the situation and chose to release him on his own recognizance and arranged for him to be flown to BWI at the expense of his father, where he was greeted by his father and where he’s been living in Mintgomery County ever since”, Sanchez’ attorney, Andrew Jezic, told News4.
Jezic believes his client will be acquitted in a jury trial and plans to claim asylum for Sanchez-Milian following the criminal proceedings.
Police described the bathroom where the rape occurred as being in a remote area of the school and said the rape took place early in the morning.
The rape allegations come less than a month after President Donald Trump directed the Department of Homeland Security to create an office that will focus on crimes committed by undocumented immigrants.
The issue escalated and received national attention after being referenced during a White House briefing Tuesday.
“What he’s feeding into is this Trump energy against immigrants in a manner that I think is totally irresponsible”, said Montgomery County Council President Roger Berliner, D-Potomac-Bethesda. At a PTA meeting on Tuesday, school officials handed out literature explaining they were legally obligated to educate any resident under the age of 21, under Maryland state law.
In a Thursday email obtained by WUSA, Montgomery County Public Schools superintendent Jack R. Smith said: ‘While I know this tragic incident has become part of a national political debate, I want to remind community members that the lives of real students have been forever affected.
“We’re going to support all of our students”.
Five days after “the incident”, Smith said in a news conference: “We all take responsibility”.

On that point, however, Montgomery County Police Capt. James Humphries called the White House’s narrative into question. “We don’t have all the information”.
“Henry Sanchez, 18, and Jose Montano, 17, were clearly not the best citizens of Guatemala and El Salvador, respectively”, WND’s Paul Bremmer informed.
Immigration officials now are pursuing Sanchez Milian’s deportation and say they have asked local authorities to alert them if he were to make bond. The father said he paid for his son’s flight to Maryland and picked him up at Baltimore-Washington International Marshall Airport, Jezic said.
Warning Americans that violence and other criminal behavior of illegal aliens expands far outside any particular school, city, county or state, Conservative Review Senior Editor Daniel Horowitz says America is paying the price for its decision to be a sanctuary nation. Sanchez was ordered to appear before an immigration judge, Bourke said, but that appearance has not been scheduled.
“ICE fully vetted him”.
This is a not a he-said / she-said scenario, or a case of regretted consensual sex.
According to the Transactional Records Access Clearinghouse at Syracuse University, more than half a million cases are pending in immigration courts across the United States.
A probable cause statement filed on March 17 at the Montgomery County District Court by the arresting officer painted a harrowing picture of the rape, based on an interview with the alleged victim and physical evidence gathered at the scene.
Montano asked her again, then forced her into a boy’s bathroom and into a stall, where he and 18-year-old Henry Sanchez raped her, police said. He did not know which agency held Sanchez Milian that long.
If a law like the one under consideration by the Maryland legislature had been in force, Sanchez and Montano might have been shielded from a deportation hearing because authorities would have been prevented from asking them about their immigration status or even their country of origin.
