Officer: Police saved his life by shooting homeless man
Sandy’s attorney, Sam Bregman, said the officers acted in accordance with their training and should not have to face a jury trial.
Pro Tem Judge Neil Candelaria said Tuesday that the state had presented enough evidence in the preliminary hearings to meet the standards for probable cause, and to file murder charges against Officer Dominique Perez and Officer Keith Sandy, who is now retired.
Video of the shooting showed Boyd appearing to surrender before he was shot.
Closing arguments are set in a preliminary hearing for a former and current Albuquerque officer facing murder charges in a homeless man’s shooting death. A judge is listening to testimony and will decide if Sandy and Perez should stand trial for the fatal shooting of a homeless man in 2014. Bregman asked in his closing argument.
Over several hours, Boyd talked with officers, at one point claiming to be “the Department of Defense”.
“He was shot in the back and in the side”, McGinn said.
The shooting sparked angry protests in Albuquerque.
The video footage drew national attention to the Albuquerque Police Department, which was being investigated at the time by the U.S. Justice Department over officers’ use of force.
Advocates who previously led demonstrations said city official could expect more civil disobedience if the judge decides the two officers won’t stand trial.
