Pensioner Wins Case Against Apple For Wiping His iPhone Photos
At the High Court in London, Deric White, 68, was awarded £2,000 after a staff member in the Apple Store in Regent Street lost hundreds of videos and photos. White says that after staff returned the phone to him saying it was “sorted”, he realized all his pictures, videos and contacts had been wiped from the device.
White then filed a lawsuit against Apple for £5,000 (~$7,500), claiming that Apple employees were “negligent” with his photos and data.
“My life was saved on that phone”.
The apple spokesperson went on to say that the employee cautioned White that in repairing his handset, the “data was in jeopardy and he could not guarantee its integrity”, adding that Apple’s workers usually tell such things to clients prior to performing any action.
A British man is celebrating a victory for the “common man” after successfully suing Apple for accidentally wiping treasured photos from his phone.
In the meantime, White, and anyone else with precious data stored on a mobile device, should take a moment to ensure it’s all backed up somewhere else.
On the other hand, Apple is very confident that the company won’t lose the lawsuit, explaining that “the claimant has not demonstrated how he suffered any loss”. He also lost all his contact data.
“Just because damages are hard to assess does not disentitle a claimant to compensation”, she said. “In doing that, he made the decision to hand the phone over to them knowing the iPhone was not backed up and the pictures and videos were therefore at risk”, said Apple attorney Victoria Nottage.
However, the judge disagreed with Apple’s version of events and ruled the case in Mr. White’s favor.
Following the ruling, White told The Mirror: “They have dragged me through the mud for this”.
“Big firms like Apple think they are invincible, but it’s about time someone brought them to book for the way they treat people”.
