Prosecutors push for Oscar Pistorius murder conviction
South African prosecutors filed an appeal calling for Paralympian running star Oscar Pistorius to be convicted of murder for the 2013 shooting killing of girlfriend Reeva Steenkamp.
Court registrar Paul Myburgh confirmed the prosecution’s papers had been filed.
Pistorius, 29, a former Paralympic gold medallist, is due after his planned release on Friday to spend the balance of his sentence at his uncle’s three-storey mansion in a leafy suburb of South Africa’s capital Pretoria. Legal professionals for the double-amputee runner have till September 17 to file their response forward of a listening to in November.
Pistorius has spent 10 months in jail for shooting dead his girlfriend Reeva Steenkamp, after his conviction for manslaughter past year. They said Masipa made an error in interpreting the law when she cleared Pistorius of murder and found him guilty instead of an unintentional but still unlawful killing. Pistorius was as an alternative discovered responsible of culpable murder, or manslaughter, for capturing Steenkamp by means of a rest room cubicle door in his house.
It’s possible to be convicted of murder in South Africa if it’s shown that the person foresaw the possibility of someone’s death because of their actions and went ahead anyway.
Pistorius will be freed two days after Steenkamp’s birthday.
“It is important to note that the offender was sentenced in terms of section 276 1i, of the criminal procedure act, which states that such an offender must be considered for placement under correctional supervision after serving at least one-sixth of his or her sentence, which in the case of this offender amounts to 10 months”. They might convict Pistorius of homicide with a easy 2-1 or Three-2 majority.
