Rahul Gandhi May Have to Face Trial in Defamation Case
However, the Congress, which is all up in arms to defend their first family (or say lifeline) is maintaining that there is no question of offering a public apology or regret for Rahul Gandhi in this case.
The Supreme Court’s observation sends a message not only to Rahul but all others too not to make a sweeping statement against the RSS, holding the whole organisation responsible for the Mahatma’s assassination.
According to a kin of the victims, Gandhi, who spent around 40 minutes with the family members, said he is “ashamed” that such incidents are taking place in India.
RSS activist Rajesh Kunte had filed the defamation suit in a Maharashtra court against Gandhi.
Rahul had moved the Supreme Court in May past year seeking quashing of the criminal defamation case lodged against him for his comments.
Congress President Sonia Gandhi, launching a frontal attack on the Modi government, said that it was “anchored in slick marketing events, glib marketing slogans, repackaging and in embellishment and exaggeration”.
“We will examine whether what the petitioner (Rahul) said comes within the ambit of defamation”, the Supreme Court said and adjourned the case to July 27. “You have to face trial, if you don’t express regret”, the bench said.
Wondering why the Congress leader made a speech quoting “a wrong historical fact’, the court also said: “Freedom is not crippled or curbed. He listened to us patiently and assured us all help so that we can get justice”.
She accused the central government of trying to topple Congress governments in Arunachal Pradesh and Uttarakhand. “Any remark exchanged at the bar between counsel for the parties and court can not be commented upon as the matter is subjudice”, he said. “People who hurt us should leave”, he said.

The ruling comes on a petition moved by Rahul Gandhi himself in May 2015 seeking quashing of a criminal case lodged against him for his comments against the RSS during a rally in Thane, near Mumbai in March 2014.
