Rowan County clerk’s latest motion says judge’s order is ‘moot,’ should be
Kim Davis is set to return to work on Monday.
There had to be a better way to handle Kim Davis’ refusal to issue marriage licenses to same sex couples.
Davis has refused to issue licenses to straight or gay couples, citing her religious beliefs, since the U.S. Supreme Court’s landmark gay marriage decision in June.
After multiple losses in court and almost a week in jail, Kentucky county clerk Kim Davis is still trying to get out of issuing marriage licenses to same-sex couples.
Following Davis’ release, lead singer Frankie Sullivan posted on Survivor’s official Facebook page that they did not grant her any rights to use that song.
In a statement to Billboard, Survivor’s founding member Jim Peterik said he was “surprised and dismayed at the misuse of the song”.
Atty. Roger Gannam from Liberty Counsel said there is still a problem under this arrangement proposed by the judge. An email was sent out by the American Family Association yesterday in support of not only Davis but a call to arms for “states to make accommodations for all Christians like Kim Davis“.
One of her deputy clerks said he will issue those licenses even if his boss tells him not to.
I applaud her for having strong convictions, because I think that’s something we can use more in public service.
There has been some conflicting reports about the validity of a marriage license if the County Clerk’s signature is not on the document. “We are asking the court of appeals to stay its enforcement now that plaintiffs received what they sought”, said Liberty Counsel founder and chairman Mat Staver, who is handling some of Davis’ legal work.
But Ms Davis’ lawyers allege that order was issued improperly and again have asked for a delay.
Following Davis’ arrest, her deputies were ordered to resume issuing same sex marriage licenses; five of six of her deputies agreed to comply with the order, with her son being the lone exception. Because Davis is now a Christian and takes her faith seriously, she does not want to undermine an institution she believes God created, and in a way, she herself had undermined it prior to asking Jesus for forgiveness.
