Stormy Daniels Sues President Trump, Says Nondisclosure Agreement Was Invalid
The timing of the LLC’s formation is significant.
By Monday of this week, Melania Trump was participating in her more regular official duties, at the President’s side for the visit of Israeli Prime Minister Benjamin Netanyahu and his wife, Sara.
“I think that’s exactly what this is”, Carney said. “You can do anything”.
But her lawsuit claims that she and Trump had an “intimate relationship” starting in 2006 and going into 2007.
“It strains credibility to conclude that Mr. Cohen is acting on his own accord without the express approval and knowledge of his client Mr. Trump”, reads the suit.
The steamy details of the agreement have been revealed after Stormy – real name Stephanie Clifford – announced she was suing the President overnight, alleging he never signed the “hush agreement” his lawyer had put together just days before he was to become the most powerful man in the world.
Marlow went on to doubt that Clifford would be able to repay the $130,000 involved in the “hush agreement” if it is ruled invalid-despite the fact that Clifford’s lawyer has implied otherwise-and suggested the whole lawsuit is a publicity stunt.
The parties to the Hush Agreement were Clifford, Trump and Essential Consultants (EC). Trump has never publicly addressed Clifford’s allegations. Clifford also signed under a different name, Peggy Peterson. The settlement agreement between Cohen and Daniels spells out arbitration as a way parties would resolve disputes. Clifford signed the agreement on the allotted line for “PP” on October 28, 2016.
Last month, Cohen said that he had paid $130,000 out of his own pocket to Clifford, and that he had not been reimbursed by the Trump Organisation or the campaign.
Daniels is said to have been ordered to sign the NDA five years later, shortly before Trump won the 2016 election.
At the time of the Journal’s report, Clifford’s lawyer released a statement from the actress denying the affair.
On Feb. 13, Cohen issued a public statement about the fiasco.
At the same time, the attorney’s confession also paved way for Daniels to speak out about the terms of the alleged agreement and what led to the payoff without fear of legal retaliation, as Cohen had breached their contract by publicly talking about it in.
According to the agreement, that means “any and all artistic media, impressions, paintings, video images, still images, e-mail messages, text messages, Instagram message, facebook posting or any other type of creation by DD”.
NBC News, which first disclosed Daniels’ lawsuit, reported Wednesday that Cohen secured only a temporary restraining order against Daniels as a result of the private arbitration proceeding.
