Student faces assault charges for throwing baby carrot at teache
Not so, however, since May has now been on school suspension for over a month and will have to go to court.
School records obtained by WTVR indicate the carrot was described as being used as a weapon.
If there is a history between the “carroted” teacher and Aliya (or, if Aliya has a lengthy discipline record in general), this may account for the seemingly harsh charge.
“I don’t even know how to combat the stupidity”, said Karrie May, Aliya’s mother.
Now, she’s being charged with assault and battery with a weapon. She tells WTVR she never thought the carrot would actually hit the teacher.
“I don’t understand this”, May continued, according to Newser. If they would have called and said she’s in trouble, she got a couple days in-school, maybe a day or two out of school.
It doesn’t indicate if the admission was regarding the mere chucking of the carrot, or for the official charge of assault. Now Aliya awaits a summons to see what happens next.
WTRV’s legal expert notes the hardness of the veggie projectile could be a key factor in the case. “If it’s a raw carrot, you don’t have to have an injury or show you were hurt to prove a battery”, Stone explained. It just has to be an offensive, vindictive touch.
“This is not the kind of thing I think a judge would necessarily find her guilty of. That’s what the law says”, May’s attorney Todd Stone said.
Karrie said her daughter’s school’s disciplinary review board sent a letter to the family asking May to admit her guilt, but they declined.
He added, “They may offer her [Aliya May] counseling, sort of a carrot at the end of a stick”.
