USA attorneys scrambling after abrupt dismissals by Sessions
Bharara, who served in the Southern District of NY, was one of 46 US attorneys asked to resign last week.
“The U.S. attorneys are political appointees, and all 46 of the holdovers from the Obama administration received the same resignation letter”.
“Just not very long ago, the president was saying that he was going to keep the USA attorney there in NY”.
During his more than seven years at the powerful criminal justice perch he also became the scourge of NY lawmakers on both sides of the political aisle, notably taking down on federal corruption charges the former Democratic speaker of New York’s assembly as well as the former Republican majority leader of the state Senate.
Some have speculated that Bharara was removed because he may have been investigating, or was about to investigate, the previous business dealings of President Trump, the Trump organization, or Trump’s business friends and former associates.
Marc Mukasey, the son of former Attorney General Michael Mukasey and a “protege” of former New York Mayor New York Giuliani, emerged as a leading contender this weekend after Trump fired Bharara.
Bharara’s career as USA attorney for the Southern District of NY came to an abrupt end this weekend. Although he has his fans in the NY legal community, I remember when he subpoenaed Reason Magazine for the names of commenters who had made over-the-top (but not actionable) comments about a federal judge Bharara practiced before – and then banned Reason from publicizing the subpoena by subjecting them to a gag order.
U.S. attorneys are political appointees requiring confirmation by the U.S. Senate.
Last week, the president claimed that former president Obama had ordered his Manhattan headquarters, Trump Tower, be bugged by the intelligence agencies.
If that suspicion were supported by some evidence, then Bharara would have been right to refuse to resign when asked to do so after declining to take Trump’s call.
Every presidential administration generally appoints its own US attorneys, though some prosecutors were taken aback by the sudden nature of the Friday direc tive.
Fox News did not have any comment Monday.
A spokesman for the US attorney’s office said Bharara wasn’t saying what he meant by his Moreland Commission reference.
During his nearly eight-year tenure, Bharara most notably wielded the full power of the S.D.New York against SAC Capital Advisors for insider trading, shutting down the hedge fund, and winning a $1.8 billion settlement. In between, he was a partner at the Cleary Gottlieb Steen & Hamilton law firm.
Robert Schumer did not immediately respond to a request for comment.
In March 2016 he oversaw the shock United States arrest of Turkish-Iranian gold mogul Reza Zarrab, who was connected to a 2013 corruption scandal that ensnared the government of then premier, now president, Recep Tayyip Erdogan. Ralph Marra filled the position in an acting capacity until Fishman took office in October 2009. Similarly, a post on Sean Hannity’s site announced, “AMNESIA: Bill Clinton and Janet Reno Fired All 93 U.S. Attorneys at Once”. “Media “Double Standard at Play” in Coverage of U.S. Attorney Firings”, a representative LifeZette headline read. And yet, no matter what anyone at Fox or otherwise says, nothing about the firing of Bharara, aka “Sheriff of Wall Street” feels common.
Bharara had pushed for trials in civilian courts while Sessions has criticized that approach and vouched for the ongoing value of trying foreign defendants before military tribunals.
One of those subpoenaed, according to the two people, is Mark Kranz, the former chief financial officer for Fox News who oversaw the network’s finances when it paid millions of dollars in settlements.
