Victim’s family: “Making a Murderer” is “very one-sided”
The series follows the cases of Steven Avery and Brendan Dassey, two Wisconsin men convicted of the 2005 murder of 25-year-old Teresa Halbach.
Steven Avery was convicted over the death of Teresa Halbach in 2007 in Wisconsin. “But, as part of the circuit court motion he also asked for release on bond pending the outcome of that motion and or an appeal”, says Bellin.
One of the motions claims a search warrant executed on the property was invalid, meaning evidence from the search should have been inadmissible. And according to Fox 6 Now, he claims that Halbach’s Toyota wasn’t sealed with tamper-proof tape, meaning that police could open and close doors and plant evidence, like Avery’s blood. “We are continuing to examine every aspect of Mr. Avery’s case and all of his legal options”, Zellner told the outlet.
On Friday, January 8th we learned Avery has new counsel.
His murder conviction was the subject of Netflix’s “Making a Murderer”.
Prior to his conviction for the death of Halbach, a young photographer for Auto Trader magazine, Avery had been falsely accused of rape and served 18 years in prison.
Grace has been open about her skepticism of Avery, previously debating New Kids on the Block member Donnie Wahlberg about it. Stachowski’s interview comes one day after Avery filed an appeal. It was reported he filed an appeal “alleging violations of due process rights in his prosecution”.
The Wisconsin Attorney General’s Office could not immediately be reached for comment on Tuesday. “Brendan is my half-brother in prison and is mentioned in the new Netflix Series, Making A Murderer”.
Zellner said they will present new evidence to “the appropriate court”.
Avery said the county obtained evidence illegally through bad warrants and also tampered with evidence.
Stachowski, who appeared in the Netflix documentary, also calls Avery a “monster”, and says he “beat her all the time”. There is a strong feeling amongst viewers of the docu-series that Avery and Dassey were set up by the Manitowoc County Sheriff’s Department and did not commit the murder.
