Ward’s family files wrongful death suit against Tony Stewart
The family of Kevin Ward Jr. filed a wrongful death lawsuit Friday against Tony Stewart, who struck and killed Ward with his sprint-car during a race in Upstate New York almost one year ago.
A grand jury cleared Stewart of any wrongdoing in September 2014.
“Our son was truly the light of our lives and we miss him terribly every day”, they said in a statement.
Stewart is set to compete this weekend in Watkins Glen.
The family of a man who was killed in a crash involving Tony Stewart on a Canandaigua track has launched a lawsuit.
The lawsuit is seeking unspecified monetary damages.
As Pockrass notes, the case likely hinges on the Ward family’s ability to prove that Stewart held fault in Ward’s death.
“The videos did not demonstrate any aberrational driving by Tony Stewart until the point of impact with Kevin Ward, at which point his vehicle veered to the right up the track as a result of the collision”, Tantillo told the press.
An Ontario (N.Y.) County district attorney’s report stated that Ward Jr. was under the influence of marijuana at the time of the incident at a level high enough to impair judgement.
Stewart, who frequently races in extracurricular events as a hobby, was participating in a sprint race on a dirt track when Ward crashed into a wall after a bump with Stewart. “Unfortunately I have a feeling it is going to be brought up a lot this week”, Stewart said Wednesday. The suit further says Stewart also caused Ward to experience extreme terror, pain and suffering. “Tony’s actions took the life of a marvelous young, talented man”.
