What To Expect When You’re Expecting A Supreme Court Seat
The prime rebuttal to the fear-mongering that surrounds Judge Gorsuch’s nomination, however, comes from his own remarks: “A judge who likes every outcome he reaches is very likely a bad judge, stretching for results he prefers rather than those the law demands”. But it is not clear that enough Democrats would join the filibuster for it to succeed, and Republicans could change Senate rules to eliminate the filibuster for Supreme Court nominees and confirm him with a simple-majority vote. To put Gorsuch on the Supreme Court is another poke in the eye to the little guy Trump promised to remember.
In truth, nominees answer as much as they have to. Some estimates from conservatives suggest the spending deficit is even more gaping. The nation witnessed that approach by Republican senators after Justice Antonin Scalia’s death created this opening on the court more than a year ago.
As first reported by The New York Times, Gorsuch did legal work for Anschutz before his appointment to the federal bench.
Although Gorsuch certainly has the legal credentials for a seat on the Supreme Court given his 10 years at the U.S. Court of Appeals for the 10th Circuit in Denver, Democrats have already begun criticizing his conservative judicial philosophy.
That theme is echoed in ads paid for by liberal groups ranging from the Alliance for Justice to People for the American Way.
Flake is also a member of the judiciary committee, which means he’ll be front and center during Gorsuch’s grilling.
Malcolm says this confirmation process potentially will be less contested than that of future Supreme Court nominees. That’s just one of the many buildings that bears his name.
The lopsided lean to the political campaign is not a new phenomenon in Supreme Court battles. Trump has been given a gift that he never deserved, and the balance of the polarized court will be impacted for a generation or two. For many Democrats, as Professor Siegel observes, that standard will have a great deal to do with the GOP’s refusal to consider President Obama’s similarly well-qualified Supreme Court nominee, Merrick Garland.
That would be well and good, except that the Republicans hold the majority in the Senate with 52 votes.
“Research about the nomination process has been dominated by right-wing groups that stood up a response within hours [of Scalia’s death] and had a seven-figure paid media campaign active within days”, the proposal said.
That pattern might be repeating itself with Gorsuch.
The clerks backing of Gorsuch is funded by the Judicial Crisis Network, a conservative political organization.
That’s why Indivisible Charlottesville invited representatives of both Democratic Sen. McConnell was extremely critical of that move but may have to do it if that’s his last option to confirm Gorsuch. Sure, activists will attempt to tar Gorsuch as anti-women, anti-worker, anti-this-that-and-the-other, but the mild-mannered originalist is anything but the cartoon Monopoly Man this caricature tries to paint.
“There will be plenty of focus on it in due course”. “I could be wrong, though, because [the] Democratic base is furious and may demand that the Democrats go after Gorsuch with everything they’ve got”. Sheldon Whitehouse (D-R.I.) said.
The theme emerging among Gorsuch’s Democratic critics is that in cases involving big business against employees or other individuals, he tends to skew toward the more powerful interests. Equally important as the cases heard by the Court will be the ones on which it declines to rule, and the American people deserve a justice who is able to recognize the limits of his office, and willing to exercise restraint. Other groups opposing Gorsuch’s nomination include NARAL Pro-Choice Missouri, says Executive Director Alison Dreith.
But, he added, he “can’t vote for any bill that keeps premiums rising”.
