With Hours Left, Oklahoma Court Calls Off Execution Of Richard Glossip
September 15, 2015 – After Gov. Mary Fallin refuses to delay Glossip’s execution, Glossip’s attorneys notify the Oklahoma Court of Criminal Appeals that they have new evidence.
“Among the evidence is an affidavit from Michael G. Scott, a former inmate who said he served time with Sneed and overheard him bragging about framing Glossip for the murder”.
“The new evidence for the court to consider involves Justin Sneed, the man who is serving a life sentence without the possibility of parole for carrying out the killing”. They presented an affidavit from an admitted methamphetamine dealer who said he frequently saw Sneed use the drug and trade stolen items for it.
July 25, 2013 – The 10th U.S. Circuit Court of Appeals upholds conviction, says Glossip’s second trial was “fundamentally fair” and cites trial testimony that showed the motel’s books were short and that Van Treese had given Glossip a deadline to straighten them out.
Glossip’s attorneys filed the emergency motion in federal court for the Western District of Oklahoma on Wednesday in response to the state Department of Corrections’ decision to use midazolam for his execution and those of two other inmates who are set to be executed in October.
But now Glossip’s lawyers have two weeks to argue that he shouldn’t be executed at all.
“It took his breath away for a second”, Knight said. “It was a wonderful moment”.
Glossip’s appeal was granted over worrisome details regarding the evidence used to convict him.
Van Treese’s brother, Ken Van Treese, also said the family had faith in the courts.
He told media: “We all make mistakes”.
Barry Van Treese was found beaten to death in a room at the Best Budget Inn on January 7, 1997. Van Treese was staying at the Oklahoma City motel while traveling to the motels to deliver paychecks and pick up money for deposit.
From the defense perspective, in a potentially serious case of prosecutorial misconduct of withholding exculpatory evidence, the State may have arguably crossed the line by suppressing the presentation of contradictory evidence of Sneed’s statement to police interrogators, who may also have coerced the confession. Police again detained him and found him with $1,200; court records show his net pay that week was about $430. So, prosecutors claim, he promised to pay Sneed to kill Van Treese instead.
Glossip maintained his innocence Tuesday in a brief telephone interview with The Associated Press and said he remains optimistic his lethal injection will be halted.
Alex Gerszewski, public information officer for the DOC, told the World on Thursday that his agency would continue to search for a supply of pentobarbital for executions but said the current lethal injection protocol with midazolam will remain in place for Glossip until further notice.
Prejean told reporters gathered outside the gates that state officials never took the time to adequately question the case against Glossip. “I won’t let it bring me down”. Believe me, I want to live, but if my death would stop anybody else from having to go through what I went through for 18 years, I’d be more than happy to die for them. The Oklahoma Court of Criminal Appeals indicated it needs more time to review the filings. “We actually got off the road and pulled over”. She met with Glossip late Tuesday and celebrated the reprieve with Glossip’s attorneys outside the OSP facility Wednesday afternoon. She echoed Pruitt’s sentiments, saying her thoughts and prayers were will the Van Treese family.
Richard Glossip is scheduled to be executed at 3 p.m. Wednesday at the Oklahoma State Penitentiary in McAlester.
