Cruz ‘absolutely’ supports ending birthright citizenship

SHERRY: Well, you’d either have to amend the 14th Amendment, or you would have to convince the U.S. Supreme Court to overturn their earlier precedent and rule that the 14th Amendment only applies to people whose parents are legally here.
The United States confers citizenship by what’s referred as jus soli – Latin for right of soil – as opposed to jus sanguinis – Latin for right of blood. As Congressional Research Service reports, the Nationality Act of 1940 “finally and unambiguously declared all Native Americans born in the United States to be U.S. citizens”.
It must be acknowledged that although Trump’s proposal about citizenship has as little chance of being put into effect as the deportation of all 11 million illegals, it is nevertheless quite popular in some precincts. Marco Rubio of Florida – do not have the momentum or the news media attention enjoyed by Trump, who is not only denouncing immigrants here illegally in nativist language but seeking severe limits on legal immigration. It’s both a source of genuine American exceptionalism – and thus a key distinguishing characteristic between the U.S. and the nations of Europe – and one of the Reconstruction Amendments, which dramatically improved the Constitution. Donald Trump is once again dividing the Republican field, this time with his call to cease giving automatic citizenship to those born in the United States to undocumented immigrants.

Many Native Americans were also excluded from citizenship through 1924, on the principle that they belonged to their own sovereign entities within US territory. It grants citizenship to “all persons born or naturalized in the United States” and subject to its jurisdiction. Latino voters are a big presence from the West Coast to such Southern states as Virginia and North Carolina.
Immigration supporters say there’s a reason the issue hasn’t come up before the Supreme Court since 1898 – and it’s because it’s settled. On the other hand, conservative legal writers and polemicists are now saying you can just interpret the constitution differently and get rid of birthright citizenship that way.
Has it been tried before?
Honestly, before those amendments, the Constitution flat-out stank. Harry Reid – now the Senate Minority Leader – espoused ending birthright citizenship, introducing legislation to do so.
