Kelly Rutherford summoned to court with kids
Kelly Rutherford is refusing to send her kids back to Monaco, willfully ignoring the court-ordered date for custody to return to ex-husband Daniel Giersch.
The actress has gone through years of heartbreak being apart from her children.
“Unfortunately Kelly has now added child abduction to extortion and false statements on her list of actions”, Giersch’s attorney Fahi Takesh Hallin said in a statement. “Daniel can make sure wellness and the kidsis security is likely to be repaired the moment possible”.
A California official granted Rutherford sole custody in May, but that decision was subsequently reversed after yet another judge insisted the state lawmakers had no authority to rule on the case. I’m immensely grateful and overjoyed to have them again. “Since May, however, the court proceedings have been very confusing”. She’s been forced to fly to Monaco for visits with them, but has not been able to have them live with her in the U.S. for the past three years.
“It also means that no state in this country now requires me to send the children away“, She continued. “It put me as a parent in an odd place, because if nobody’s taking jurisdiction, how do you put your children on a plane to a foreign country not knowing what’s going to happen?”
Rutherford’s lawyer, Wendy Murphy, has responded to Giersch’s letter. “I haven’t stopped hugging and kissing them”.
A New York judge made the order under direction of Giersch that the actress needed to be notified by 3 p.m. today regarding tomorrow’s hearing, but that notice can be sent by e-mail or secured Facebook message.
Although the children live full-time in Monaco, they were allowed to spend the summer with Rutherford in the United States, with the stipulation they return home to Europe at the end of their monthlong holiday this week.

“He should do the right thing, honor his agreement, and protect the children from the trauma of needless litigation”, she added. “I pray that officers on this nation and in Monaco will agree that three years in exile is a really very long time in a toddler’s life, and that my youngsters have a proper to stay, as soon as and for all, in the USA”.
And Daniel believe the 46-year-old actress’ conduct throughout their custody battle will have a “traumatic impact” on the children.
